RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-01764 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: He be credited with 20 years of satisfactory service and entitled to a Reserve retirement. APPLICANT CONTENDS THAT: He completed more than 20 years of service towards a Reserve retirement; however, the records at the Air Reserve Personnel Center (ARPC) reflect that he was two months short. He was advised that he did not receive point credit towards retirement from Apr 88 – Dec 89; however, he has a special order which shows he was present 100 percent of the time in 1989. In addition, he attended the Senior Noncommissioned Officer Academy (SRNCOA) [sic] in Apr 87 and was honored with the Commandant’s Award. The applicant provides no rationale as to why his failure to timely file should be waived in the interest of justice. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: According to ARPC IMT 168, Computation of Points and Satisfactory Service Credit Summary, dated 13 Oct 13, the applicant initially entered the Regular Air Force on 1 Jul 69. Upon his release from active duty, on 19 Apr 75, he transferred to the Air Force Reserve and then the Air National Guard (ANG). On 28 Aug 90, the applicant was placed on the Temporary Disability Retired List (TDRL) with a compensable disability rating of 40 percent. He was credited with 21 years, 1 month, and 27 days of service for basic pay and 6 years, 8 months, and 14 days of active duty service. On 13 Sep 92, the applicant was removed from the TDRL and transferred to the Permanent Disability Retired List (PDRL). AIR FORCE EVALUATION: ARPC/DPTT recommends denial. DPTT records indicate the applicant received 54 active duty points for Retention/Retirement (R/R) year 19 Apr 86 to 18 Apr 87 and 44 active duty points for R/R year 19 Apr 87 to 18 Apr 88. The applicant provides the special order for his New Mexico Perfect Attendance Ribbon from 1 Jan 89 to 31 Dec 89 [sic] in an attempt to gain credit for a satisfactory year of service for R/R year 19 Apr 89 to 18 Apr 90. Unfortunately, this order only covers seven months of the member's R/R year and doesn't reflect any of the member's individual participation dates. ARPC is unable to use this award order as a source document because it is missing creditable points or days of participation. In order for ARPC to add additional points to the applicant's points history, he will need to send in source documents for all of the participation points earned in the year he is requesting points to be added. The complete DPTT evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 4 Oct 14 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force Reserve office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
